Adjudication is a form of ADR that is often used in disputes involving contracts.
Adjudication is an exceptionally speedy process, usually completed within 28 days. The process involves the appointment of an Adjudicator who hears the viewpoints of all parties to the dispute and then decides how the matter should be resolved.
Arbitration
The Arbitration ADR method is similar to a Court application and hearing. The disputing parties will jointly appoint an Arbitrator who will rule on the dispute, a bit like a court ruling only by a private judge. The benefit of Arbitration is that it is quicker and more flexible than Court proceedings and the Arbitration can be kept confidential.
Mediation
Meditation is one of the most commonly used methods of ADR. It can either be provided by specialist commercial mediators to resolve a business dispute or by family mediators to help a separating couple or parents reach a Family Law agreement. Mediation has the benefit of being quick and cost-effective as the mediation process is more flexible than a Court application.
Negotiation
Negotiation is an informal dispute resolution method, that involves parties and their legal advisors either meeting in person or corresponding to negotiate a settlement to resolve a dispute out of Court. It is important to seek legal advice when attempting negotiations during a dispute. Solicitors will help you focus the negotiations on the key aspects and advise you of your best settlement terms through negotiation or Court proceedings.
