Is Your Business Ready for the Employment Rights Act 2025?
The Employment Rights Act 2025 introduces significant changes that will soon bring new duties and obligations for employers. To stay compliant and reduce risk, it’s essential to review your policies and ensure managers are trained on the changes. You can use the checklist below to help prepare your business for these upcoming changes.
- Is your staff handbook up to date (before the ERA 2025)? Do you have the following:
- Carer’s Leave Policy
- Neonatal Leave Policy
- Day one right to request flexible working?
- Have you updated your policies and payroll processes ready for the changes to SSP from next month?
- Have you updated your whistleblowing policy to state that disclosures of sexual harassment will be treated as whistleblowing from next month?
- Have you updated your paternity leave and ordinary parental leave policies to reflect the changes next month?
- When did you last conduct an employment status review (worker/employee/self-employed)?
- When was the last time you reviewed your contracts of employment for workers and employees – are they ERA 2025 ready?
- Have you reviewed the length of your probationary periods and your procedures for probationary reviews?
- Do you have any future change plans? Can they be brought forward ahead of the changes in 2027?
- Have you trained your line managers on the new rights so they can supervise staff correctly?
- Have you considered the Phillips Employment Law Protection Scheme to limit your exposure to costly tribunal claims?
